Notes - Will of John White, Jasper County, Georgia, In the name of God amen. I, John White of the State of Georgia and county of Jasper, being perfectly sound in mind, though weak in body and advanced in years but in common health, but know that it is appointed for me as well as all other men, once to die, do make and ordain this my last will and testament, as follows, first of all I recommend my soul to God who gave it and my body to the dust from whence it came -- to be buried in a christian manner at the discretion of my executors.
1st It is my desire that all my just debts be paid and my funeral expenses out of the proceeds of sale, of some of my personal Estate, as soon as the same can be done agreeable to law after my decease - ________ the rest of my estate which has pleased God to help me with. I dispose of in the following manner - ___________
2. To my beloved daughter Mary Osborne I give and bequeath the sum of
twenty-five dollars, to be paid within two years after my death
-- To my beloved daughter Leah Brown I give and bequeath the sum of one dollar
--To my beloved daughter Elizabeth Suttle I give and bequeath the sum of one dollar
--To my beloved son John White I give and bequeath the sum of one dollar
-- To my beloved daughter Rebecca Turman I give and bequeath the sum of one dollar
-- To my beloved grandson Wilson White I give and bequeath the sum of fifty dollars - to be paid within two years of my death
--To my beloved grand daughter Sally White I give and bequeath the sum of fifty dollars - to be paid within two years of my death.
3. All the rest of my estate both real and personal I give and bequeath to my dutiful wife and my four youngest children - _________ my wife Barshaba White and my sons Henry B. White, James R. White, Archibald B. White and William P. White, which estate I wish to remain in the hands or possesion of my said wife, undivided during her natural life or until my four youngest children, or either of them arrives to the age of twenty one years or marries, in either of the events it is my wish that what can be spared out of said estate be valued and given to them as they come of age at the death of my beloved wife and equal division take place, having due regard to what each of my said four children may have had allotted to them at the time of their becoming of age or marrying -- I wish my Executor, whenever they think proper to sell two tracts of my estate, and either divide the money amongst my said wife and four youngest children, or buy _____ near to where I now live, or some other property for the benefit of my said wife and four youngest children.
4. If my wife should die unmarried after my death or either of my children last named before they should arrive to the age of 21 years, that part of said estate that said wife or child so dying should have been entitled to be equally divided amongst the said last mentioned legatees.
5. If my said wife should marry after my death, and thereby said estate should be wasted, or _________ so to be done, then and in that case, I wish a division and my said wife to have a child's part, with my four last mentioned children, and for her executing to cease and for my other one to transact all of my said _________ touching of my said estate--My Executor and executrix are hereby requested and directed safely to keep and appropriate to the use of my before named four youngest children Henry B White, James R White, and Archibald B White and William P White, before pointed _________ when they severally come of age.
6. I do hereby nominate, constitute and appoint my trusty friend Isham Gunter, my executor and my beloved wife Bashaba White my executrix to this my last will and testament, to execute the same agreeable to the tenor of the same.
7th I do hereby revoke, nullify, and make void all former wills by me made, and ratify, confirm and make value this and this only, my last will and testament - In testimony whereof I have hereunto set my hand and affixed my seal, this 31st day of July in the year one thousand eight hundred and twenty three.
